Adhesion Contract for the Purchase and Sale of Industrial Products

Welcome to the platform of MOLBER Solutions S.A. de C.V. By accessing, browsing, or placing orders through our digital channels, you agree to be bound by these Terms and Conditions.

1. PROVIDER DECLARATIONS

MOLBER Solutions declares to be a company incorporated under Mexican law, domiciled at Atlixcáyotl 1499 Col, Reserva Territorial Atlixcáyotl, PISO 3, San Andrés Cholula, Puebla, with a customer service number of +52 442 247 0473.

2. OBJECT AND SCOPE

This contract regulates the acquisition of mechanical connectors and couplers for corrugated rebar. The technical description of the products on the website is binding. MOLBER Solutions guarantees that the products comply with the official Mexican standards applicable to the construction sector.

3. PURCHASING PROCESS AND PRICES

  • Prices: All amounts are presented in National Currency (MXN) and include Value Added Tax (VAT), unless otherwise indicated.
  • Payment Method: Only Electronic Funds Transfers (SPEI) are accepted. The client must send the payment receipt to initiate the dispatch process.
  • Confirmation: The order will only be considered formalized after the confirmation of funds in the MOLBER Solutions bank account.

4. LOGISTICS, DELIVERY, AND RISK

Given the nature and weight of mechanical connectors, delivery logistics are variable.

  • Freight: Shipping costs will be quoted separately depending on the location and volume of the order.
  • Times: Estimated delivery times will be communicated to the client at the time of quotation. MOLBER Solutions is not responsible for delays derived from force majeure or failures in the service of external carriers.

5. RIGHT OF REVOCATION (ART. 56 LFPC)

According to the Federal Consumer Protection Law, the client has the right to revoke their purchase consent within the 5 business days following the delivery of the product, without any responsibility, provided the product has not been used or installed and is kept in its original packaging.

6. RETURNS AND WARRANTY POLICY

  • Term: MOLBER Solutions grants a period of 30 business days after receipt to request returns for verifiable manufacturing defects.
  • Exclusion: Returns will not proceed for errors in size selection by the client or if the connector has already been installed or manipulated on site.
  • Procedure: To initiate a claim, you must contact customer service attaching photographic evidence of the defect.

7. TECHNICAL RESPONSIBILITY

MOLBER Solutions provides high-precision mechanical components; however, it is not responsible for damages derived from incorrect installation, the use of incompatible rebar, or the failure to comply with the structural specifications of the project by the client.

8. INTELLECTUAL PROPERTY

The content, logos, and commercial names "MOLBER Solutions" are the exclusive property of the company and are protected by Industrial Property laws in Mexico.

9. JURISDICTION AND COMPETENCE

In case of controversy, the parties submit to the administrative competence of PROFECO and, failing that, to the laws and courts of San Andrés Cholula, Puebla, waiving any other jurisdiction that may correspond to them by present or future domicile.
